Terms of use

These terms of use (the “Agreement”) govern the use of and access to the Ecocrew App and Website (each as defined below) including any content, functionality and services offered on or through the Website or the Ecocrew App.

This Agreement is entered into between you as the customer (“You” or “Customer”) and Ecocrew (referred to individually as a “Party” or collectively as the “Parties''), where You wish to use the Ecocrew App and/or Website to engage service professionals (collectively or individually referred to as “Pickup executive/delivery partner”) ”) who wish to provide Pickup/delivery Services (as defined hereinafter) to You using the Ecocrew Platform (as defined hereinafter). If You do not agree to accept and be bound by this Agreement, You must immediately stop using the Ecocrew Platform. By using the Ecocrew Platform or any portion thereof, you accept and agree to be bound by this Agreement.

PLEASE READ THIS AGREEMENT THOROUGHLY AND CAREFULLY.

Capitalised terms in this Agreement have the meaning given to them in Exhibit A if not otherwise defined in the body of this agreement.

THIS AGREEMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY. THESE TERMS REQUIRE THE RESOLUTION OF ANY DISPUTES ON AN INDIVIDUAL BASIS, AND YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. BY USING THE ECOCREW PLATFORM, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS.

The parties agree to the following:

GENERAL

This Agreement constitutes a legally binding agreement between Ecocrew and the Customer. This Agreement sets out provisions that define the Customer's legal rights and obligations with respect to its use of and participation in (i) the Ecocrew Platform as a whole, including the classified advertisements, forums, various email functions and internet links, and all content, functionality and Ecocrew services available through the domain and subdomains of Ecocrew located at www.ecocrew.in (collectively referred to herein as the "Website”) and the Ecocrew app, and (ii) the online transactions between Customer and those Pickup executive'/delivery partner' who are providing services via the Ecocrew Platform (collectively “Services”).

You acknowledge that the Ecocrew is a platform where business entities facilitate the sale of paper, plastic, metal & electronic scrap materials, bookings for these pickup/delivery Services and by using, visiting, registering for, and/or otherwise participating in this Website or the Ecocrew App, including the use of any services presented, promoted, and displayed on the Ecocrew Platform, and/or by clicking on "I have read and agree to the terms of use" or similar language acknowledging acceptance of the terms (when this option is made available to you), You hereby certify that: (1) You are a Customer, (2) You have the authority to enter into this Agreement, (3) upon confirmation of a booking by You, You agree to make payment for the Professional Services requested from the Ecocrew App, and (4) You agree to be bound by all terms and conditions of this Agreement and any other documents incorporated by reference. Furthermore, You represent and warrant that (a) You are at least 18 years of age or the age of majority in the relevant jurisdiction, whichever is greater, and are fully able and competent to enter into and comply with this Agreement, and (b) You are entering into this agreement in your individual, personal capacity, and not on behalf of any organisation or entity.
